Staatenbericht des Europarats zu Deutschlands Menschenrechtspolitik

2024-03-24 b.jpgAuch ein dreiviertel Jahrhundert nach ihrer Deklaration (1) sind die allgemeinen Menschenrechte (2) kein Relikt der Vergangenheit. Im Gegenteil: Kriege, Gewalt, Diskriminierung oder der Umgang mit Asylsuchenden sind Beispiele für einen Wettlauf nach unten. Tagtäglich wird die Menschenwürde verletzt.

Das Amt des Menschenrechtskommissars bzw. der Menschenrechtskommissarin ist eine im Jahr 1999 vom Europarat geschaffene unabhängige und unparteiliche Einrichtung zur Förderung des Bewusstseins für die Menschenrechte und ihrer Achtung in den 46 Mitgliedsstaaten des Europarates. 

Die Menschenrechtskommissare verfassen Berichte, die auf ihren offiziellen Besuchen in verschiedenen Ländern basieren. Sie dienen dazu, die Menschenrechtslage vor Ort zu bewerten, auf mögliche Defizite hinzuweisen und Empfehlungen zu geben, wie sie besser durchgesetzt werden können.

Die Parlamentarische Versammlung des Europarats (PACE) wählt den Menschenrechtskommissar bzw. die Menschenrechtskommissarin für eine nicht verlängerbare Amtszeit von sechs Jahren. Am 31. März 2024 endet die Amtszeit der bosnisch-serbischen Menschenrechtskommissarin des Europarats Dunja Mijatović. Zu ihrem Nachfolger wählte PACE am 24.Januar 2024 den Iren Michael O’Flaherty.  PACE hat sich bis heute noch nicht vollständig von dem Korruptionsskandal erholt, in dem  Aserbaidschan  PACE-Mitglieder dafür bezahlte, Kritik an der schlechten Menschenrechtsbilanz des Landes abzuschwächen. Dunja Mijatović  und ihr Team besuchten vom 27. November 2023 bis zum 1. Dezember 2023 Deutschland und veröffentlichten dazu am 19. März 2024 (5) einen Bericht  (6), den das Deutsche Institut für Menschenrechte so zusammenfasste:

„Der Länderbericht der Menschenrechtskommissarin des Europarats, Dunja Mijatović, verdeutlicht: Soziale Rechte werden in Deutschland oft nicht als Grund- und Menschenrechte angesehen, die der Staat verwirklichen muss. Das betrifft unter anderem das Recht auf einen angemessenen Lebensstandard, das Recht auf Bildung oder das Recht auf Wohnen. Hier besteht noch sehr viel Handlungsbedarf. Der Bericht der Menschenrechtskommissarin ist eine wichtige Grundlage für die Politik, soziale Ungleichheit in Deutschland zu vermindern.

Die Menschenrechtskommissarin zeigt sich in ihrem Bericht sehr besorgt über die hohe Zahl der Menschen in Deutschland, die in Armut leben und von sozialer Ausgrenzung betroffen sind. Diese Zahl stünde in keinem Verhältnis zum Wohlstand des Landes. 

Sie kritisiert die anhaltenden Narrative im politischen Diskurs sowie in den Medien, die Menschen in Armut eigenes Versagen und Trägheit als Ursache ihrer Situation vorwerfen. Sie macht unmissverständlich deutlich: strukturelle und generationsübergreifende Benachteiligung und Ausgrenzung verhindern den effektiven Zugang zu sozialen Rechten.

Konkret fordert sie Deutschland auf, die Höhe der Sozialleistungen an das aktuelle Preisniveau und die tatsächlichen Bedarfe anzupassen; die Antragsverfahren müssten vereinfacht und Antragsberechtigte umfassender informiert werden. 

Sie zeigt sich insbesondere alarmiert ob der großen Zahl an Kindern in Deutschland, die in Armut leben.

Die Menschenrechtskommissarin zeigt sich zudem besorgt über die hohe Zahl der wohnungslosen Menschen in Deutschland, vor allem über die hohe Zahl der Familien und jungen Menschen. Sie fordert die Bundesregierung dazu auf, den Nationalen Aktionsplan gegen Wohnungslosigkeit zügig zu verabschieden. Mijatović ruft Deutschland außerdem nachdrücklich dazu auf, dringend mehr bezahlbaren Wohnraum zu schaffen, auch mit Eingriffen in den Wohnungsmarkt.

Dringenden Handlungsbedarf sieht die Menschenrechtskommissarin auch bei der Verwirklichung der Rechte von Kindern und Jugendlichen. Das Kindeswohl stünde bei Behörden und öffentlichen Einrichtungen oftmals nicht im Fokus, eine Aufnahme der Kinderrechte in das Grundgesetz stehe weiterhin aus, nur wenige Bundesländer hätten das Amt einer*eines Kinderbeauftragten eingerichtet und es fehle weiterhin an einer entsprechenden Stelle auf Bundesebene. 

Die Menschenrechtskommissarin zeigt sich zudem besorgt über fehlende effektive Beteiligungs- und Beschwerdemöglichkeiten. 

Bezüglich der Inklusion von Menschen mit Behinderungen sieht die Menschenrechtskommissarin nur sehr begrenzte Fortschritte. Ein unabhängiges Leben in der Gemeinschaft sei für viele Menschen mit Behinderungen weit entfernt. Sie müssten nach wie vor in Sonderstrukturen lernen, arbeiten und leben – sei dies in Sonderschulen, Werkstätten oder Wohnreinrichtungen.“ (7)

„Im Themenbereich Antidiskriminierung kritisiert die Kommissarin die im europäischen Vergleich begrenzten Kompetenzen der Antidiskriminierungsstelle des Bundes („eine der schwächsten Gleichbehandlungsstellen in Europa“), mangelnde Aufmerksamkeit und Ressourcen für die Förderung von Gleichbehandlung sowie das Fehlen einer interministeriellen Strategie zum Themenfeld Antidiskriminierung.“ (8)

Der Bericht ist im wahrsten Sinne des Wortes ein Armutszeugnis für die drittstärkste Volkswirtschaft der Welt. Die neoliberale Politik der 1990er Jahre im Geist von Privatisierung, Deregulierung, Finanzmarktverherrlichung, Ich-AG’s und Wettbewerb zeigt zwiespältige Ergebnisse. Vielen Menschen in Deutschland geht es gut, aber gleichzeitig werden viele „abgehängt“ und ausgegrenzt.  Die  Armut in Deutschland steigt kontinuierlich weiter an. Mittlerweile gelten 20% der Bevölkerung als armutsgefährdet. Viele leiden unter prekären Wohnverhältnissen und schlechter Gesundheit. Ihnen und ihren Kindern fehlen Ressourcen, um vollumfänglich am gesellschaftlichen und politischen Leben teilzunehmen. 

Der Bericht der Menschenrechtsbeauftragten beschreibt insofern auch eine Vernachlässigung der staatlichen Fürsorgepflicht. Armut verletzt die Grundrechte auf Bildung, Gleichheit, Gesundheit, Energie, Arbeit.

Sozialstaats- und Infrastrukturausgaben sind auch Investitionen in eine nachhaltige Zukunft. Sie können besonders den Kindern Perspektiven eröffnen, Sicherheit und Solidarität schaffen und die Demokratie stärken.
